- Wrongful Death Actions
When a death is caused by the misconduct or negligence of another person or company, the law provides for compensation of the survivors, which may include the spouse, parents, and children of the deceased. The misconduct or negligence can range from an act of momentary negligence or carelessness to an intentional or reckless act. In Texas, the law allows for the compensation to the survivors based on the damages suffered by the deceased, as well as the loss suffered by the survivors themselves, including pecuniary loss (loss of care, maintenance, support, services, advice and contributions of monetary value), mental anguish, loss of companionship, and loss of inheritance.
- Premises Liability
When someone is injured as a result of unsafe property or building conditions, they may have a right to make a claim for their damages against the owner of the property. A business owner has a duty to provide a safe place for its employees to work and its customers to visit. At DeHart Crockett, P.C. we handle premises liability that has resulted in serious identifiable injuries to the individual.
- Products Liability
Product manufacturers and retailers have a responsibility to protect the consumers who use their products. Manufacturers and designers must ensure that their products are not defective or inherently dangerous when used appropriately, and wholesalers and retailers are expected to keep unsafe products off their shelves. If this is not done, consumer may have a claim against the person or entity that participated in making or marketing a defective product or an entity that put such product into the stream of commerce. This suit could include all entities in the product's chain of distribution responsible for the harm. DeHart Crockett, P.C.'s estate planning services are designed to assist any client, but particularly those clients whose estates, including life insurance proceeds, are likely to be subject to federal estate tax. Estate planning can include the preparation of documents ranging from simple wills and powers of attorney to sophisticated estate tax planning vehicles, such as family limited partnerships and charitable remainder trusts. We also counsel our clients regarding asset protection as well as appropriate pre-marital or post-marital agreements that coordinate with their overall estate plans. With our ISA allies, DeHart Crockett is able to provide full legal services to personal representatives of decedent's estates, trustees, and guardians/conservators for minors or incapacitated adults, including all proceedings in the probate court and estate and trust administration in order to assure compliance with fiduciary laws and realization of the benefits intended for family members.
